Terms of Service

1. Business Name and Structure

Gabriella’s Creations operates as a Limited Liability Company (LLC), registered in the state of Georgia.

2. Purpose of Business

Gabriella’s Creations provides the following services:

• Illustration for print and digital media.

• Graphic design for branding, advertising, and promotional materials.

• Concept art and visual development.

• Educational talks and lessons.

• Consultation services on design and creative strategy.

​Additional services may be offered based on client needs and project requirements.

 

3. Business Operations

3.1. Location
Gabriella’s Creations is based in Hinesville, Georgia. Services may be provided remotely or at other locations as needed.

3.2. Hours of Operation
Work hours are flexible and determined by the freelancer. Specific deadlines or schedules will be agreed upon per project.

3.3. Equipment and Materials
Gabriella’s Creations uses professional tools, including Adobe Creative Suite and a Cintiq tablet. Any additional resources or specialized equipment required for a project will be discussed and agreed upon with clients.

 

4. Compensation and Payment Policies

4.1. Rates
Project rates are based on scope, complexity, and deadlines. Rush requests, such as quick turnarounds, weekend, or holiday work, may incur additional fees.

4.2. Payment Terms
Clients are invoiced upon project initiation, completion, or at agreed-upon milestones.
Standard payment terms are Net 15/30 days unless otherwise specified in writing.

4.3. Late Payments
Overdue invoices may incur a 1.5% late fee per month on the outstanding balance.

 

5. Intellectual Property

5.1. Ownership
All original work created by Gabriella’s Creations remains the intellectual property of the freelancer until payment is received in full. Once payment is complete, ownership rights transfer to the client as outlined in the project contract.

5.2. Licensing
Gabriella’s Creations reserves the right to use completed work for portfolio displays, website features, and marketing unless a signed non-disclosure agreement (NDA) restricts these rights. Compensation for relinquishing these rights may be required.

 

6. Client Obligations

Clients must provide clear project briefs, timelines, and any resources necessary for the successful completion of the project.

 

7. Confidentiality

All client materials and information not intended for public use will remain confidential, as per the terms outlined in individual project agreements.

 

8. Termination

Either party may terminate a project with seven (7) days' written notice. Gabriella’s Creations reserves the right to invoice for work completed up to the termination date, with charges ranging from 25% to 100% of the total project value, based on the work's progress.

 

9. Dispute Resolution

Disputes exceeding $15,000 will be submitted to mediation under the rules of Georgia Lawyers for the Arts. The prevailing party in litigation may recover attorney fees and costs, provided mediation was attempted beforehand.

 

10. Amendments

These Terms of Service may be updated periodically. Any changes will be communicated to clients in writing.

 

11. Governing Law

These terms are governed by the laws of the state of Georgia.

 

12. Working Hours

Standard working hours for Gabriella’s Creations are Monday through Friday, 9:00 AM to 5:00 PM, excluding public holidays. Requests for work outside of these hours, including weekends or holidays, will incur additional fees calculated at time and a half of the standard rate. Any such requests must be agreed upon in advance by both parties.
